UPDATE – JULY 13, 2018

The parties appeared this past Wednesday (July 11, 2018) at a Case Management Conference before the Honourable Madam Justice Kane to discuss the status of this proceeding and a timetable for the next steps.

A further Case Management Conference has been scheduled for 10:00 a.m. on September 7, 2018, and a further update will be provided to the class at that time.

Yup, another update saying stay tuned for another status update....just what is the status, will this case be resolved this year or is this a political agenda now. Nobody knows.

This is taken forever with no real positive info. The specifics of where they stand on negotiation would be nice to hear.

trooper can you explain a little what they are trying to go for in this matter. I am on ELB and from what i been told is the different claw backs that they do to us. I know many of you are way more informed on whats going on in these matters thanks.

Bosn,

This lawsuit is for three benefits;

1. (Earnings Loss Benefit)

2. (Canadian Forces Income Support Benefit)

3. (War Veterans Allowance)

I will explain the (Earnings Loss Benefit) part of the lawsuit:

You are part of this lawsuit if you are a Canadian Forces member, veteran, spouse, dependant, survivor, and orphan who have had their Earnings Loss Benefit reduced between April 1, 2006 and May 29, 2012, or received no benefit at all during that time, because of the deduction of disability benefit entitlements under the Pension Act.

The Key here is the dates April 1, 2006 and May 29, 2012. After this date there were some who were given an ELB lump sum retro for a short period of time from May 29, 2012 up to the Month it was adjusted.

So for you if you were not receiving ELB prior to May 29, 2012 the lawsuit does not pertain to you as far as ELB is concerned.

For those who are a part of the ELB portion of the lawsuit they the lawyers are going for a retro amount of the difference of the amount that was reduced from the pension act in the 2006 - 2012 time frame.

thank you for putting this up in words i can understand. I started my ELB 1 APR 2008 and i am still on it.
