Maj.-Gen. Dany Fortin can’t get his old job back leading Canada’s COVID-19 vaccine rollout because it no longer exists — and therefore the appeal of his removal should be tossed — the federal government argues in court filings.

Fortin has also been in a position in the Canadian Armed Forces that is in line with his rank since August, further rendering his appeal moot, government lawyers say in written arguments filed in the Federal Court of Appeal on Nov. 29.

Fortin disputes that, saying in an affidavit filed in court that the position is not commensurate with his rank and that he has not had any actual duties in the CAF since being removed as head of the vaccine rollout in May.

Fortin was dropped just days before military police referred results of an investigation to Quebec prosecutors. He was subsequently charged with sexual assault in August, related to an allegation dating back to 1988. He has denied any wrongdoing.

Alleging political interference in the decision to remove him, Fortin took his case to the Federal Court, arguing he should either get his job back or be given a position commensurate with his rank.

A Federal Court judge ruled in October that he first had to go through the military’s internal grievance process, leading Fortin to appeal to the Federal Court of Appeal.

The government has brought a motion to quash the appeal.

In an affidavit filed last Thursday, Fortin says his current position of senior adviser to the commander of Canadian Joint Operations Command is temporary — whereas he says a job commensurate with his rank would be permanent — and was created mainly to fulfil CAF rules that all serving members be assigned to a position.

The government argues that Fortin “cannot be attach posted back to a non-existent position,” and that if he’s unhappy with his current position, he can take it up through the internal grievance process.

“It is plain and obvious that due to relevant developments since the application was filed, this appeal is moot and no exceptional circumstances exist which would warrant the appeal being heard,” government lawyers argue.

It’s now up to the court to decide whether to quash the appeal based on the written arguments. No date has been set for that decision.

Maj.-Gen. Dany Fortin opts for trial by Quebec judge only in sexual assault case

The senior military officer once tasked with overseeing Canada’s COVID-19 vaccination drive is opting to have his sexual assault case tried by a Quebec judge without a jury present.

A lawyer for Maj.-Gen. Dany Fortin announced the decision during a brief hearing in a Gatineau courtroom this morning.

Fortin was removed from his position on the vaccine campaign in May and was charged with one count of sexual assault in August.

He is fighting for reinstatement to his former role with the Public Health Agency of Canada alleging Prime Minister Justin Trudeau and other senior members of the Liberal government turfed him for purely political reasons.

A Federal Court judge tossed out his request for reinstatement in October but Fortin is appealing.

His lawyer, Natalia Rodriguez, says an appeal concerning his reinstatement is expected to go to a panel hearing in the spring.

His criminal case is expected back in court Friday.
